Expert Witness
It is a sad but inevitable fact that there are situations where the business of one company is affected by the negligent or illegal actions of another. In these cases, as well as where an Insurer will deny liability for losses suffered as a result of an insured peril, the only recourse is invariably through the Courts. 

Pragmaticum will act as an expert witness is quantifying the losses suffered and providing support and evidence for their opinion. Having never acted for Insurers there is little chance that there will be any conflict in our appointment should there be a desire for mediation or joint instruction. Other than in such cases, Pragmaticum will always act for the claimant but its philosophy of driving business recovery and then looking at loss calculation underlines the integrity of its directors and therefore the veracity as well as the technical excellence of the expert opinion.

As legal action can be a lengthy process, and when not acting as an expert witness, Pragmaticum will provide support to the client in their endeavours to rebuild the business without the support of their Insurance policy or other funding. Our advice will cover the client’s responsibilities despite the loss of financial support as well as other commercial strategies to reduce operating costs etc.

Oil Pollution

Over the 19 years of working together Adrian Maurice, Malcolm Stewart Michael Fox, and Ivor Spector have been involved in the Braer, Sea Empress, Erika and Prestige Oil tanker disasters. Over this time Malcolm Stewart has become recognised as a world expert in such environmental disasters and the financial consequences of them to local fishermen and businesses. Malcolm has been responsible for successfully lobbying the International Oil Compensation Fund since the Braer (1993) to extend the scope of cover, resulting in this now being more comparable with principals of indemnity.
